There is hereby incorporated by reference for purpose of regulating public offense within the corporate limits of the City of Attica, Kansas, that certain code known as “Uniform Public Offense Code for Kansas Cities”, Edition of 2023, prepared and published in book form by the League of Kansas Municipalities, Topeka, Kansas, save and except such articles, sections, parts or portions as are hereafter omitted, deleted, modified or changed, such incorporation being authorized by K.S.A. 12-3009-12-3012, inclusive, as amended.  No fewer than three copies of said Public Offense Code shall be marked or stamped “Official Copy as adopted by Ordinance Number G-1270-23-05” with all sections or portions thereof intended to be omitted or changed clearly marked to show any such omission or change and to which shall be attached a copy of said ordinance or this article and filed with the City Clerk to be open to inspection and available to the public at all reasonable hours.

(a)   Article 5 of the said Uniform Public Offense Code is hereby supplemented, by adding the following Sections:

Section 5.9 CURFEW.

       It shall be unlawful, for any child under the age of 18 years to wander, loaf, loiter or play in, about or upon any public street, alley, sidewalk, vacant lot, parking lot, park playground, public place or other place normally accessible to the general public for public use, whether on foot or in a vehicle or by any other means after the hour of 11:00 p.m. to 5:00 a.m. on Sunday, Monday, Tuesday, Wednesday, and Thursday nights; and after hours of 1:00 a.m. on Friday and Saturday nights, and before the hour of 4:00 a.m. of any morning. This prohibition shall not apply to those children who are accompanied by a parent or other legal guardian, nor to those who are enroute by the most direct and accessible route from their homes to any authorized place of employment, authorized place of entertainment, or authorized place of attendance to their residences. The term “authorized” as used in this section shall denote prior authorization by parent or legal guardian.

       Violation of this section is a Class C violation, punishable as provided by Article 12, Uniform Public Offense Code, by a definite term of confinement of not more than one month or a fine not to exceed $500.00 or both fine and a term of confinement.

Section 5.10 SAME; PARENTS AND OTHERS.

       It shall be unlawful for any parent or legal guardian of any child under the age of 18 years to suffer, permit or allow such child to wander, loaf, loiter or play in, about or upon any public street, alley, in violation of the provisions in Section 5.8.

       Violation of this section is a Class C violation, punishable as provided by Article 12, Uniform Public Offense Code, by a definite term of confinement of not more than one month or a fine not to exceed $500.00 or both fine and a term of confinement.
