(a)   The governing body of the City of Attica hereby establishes by adoption of an ordinance a Capital Improvement Fund in accordance with K.S.A. This fund shall be used by the city to finance, in whole or in part, any public improvement need set forth in the city’s Capital Improvement Plan. Contained within this ordinance is the authority to provide for the budgeted transfer of monies from other city funds lawfully available for improvement purposes, including monies from the City’s utility funds and general fund.

(b)   Monies and such Capital Improvement Fund may be used to finance, in whole or in part, any public improvement need, including the repair, restoration and rehabilitation of existing public facilities. Further expenditures from such fund may be made for engineering and other advance public improvement plans and studies and that reimbursement may be made to the fund from bond proceeds, special assessments or State and Federal aid available for the complete project. A Capital Improvement Plan should be made each year to identify those improvements to be potentially financed from the fund during the following year, but not limited to those on the plan. This plan must be adopted and revised. It is the intent of the Governing body that such fund shall be used to be a financing mechanism for meeting the needs of the city for infrastructure improvements. This fund is also intended to provide capital for major equipment replacement or purchases.

(c)   The city clerk shall annually submit at the same time and as a part of the annual operating budget, proposed revenue allocations and budget transfers as may be necessary. The clerk shall set aside monies to be annually reserved for future improvements and to finance those improvements scheduled for completion the next year.

(d)   Monies in such fund may be invested in accordance with Kansas law K.S.A. 10-131 and amendments and any interest thereon shall be credited to such fund.

(a)   A majority of the electors voting thereon having approved, at a special question election held on the 7th of November, 2006, the levying of a retailers’ sales tax in the City of Attica, for the purpose of general city operations including residential streets and utility system improvements, as authorized by KS.A 12-187 et seq., as amended, there is hereby levied a city retailers’ sales tax in the amount of one percent (1%) to take effect on the 1st of April, 2007.

(b)   Except as may otherwise be provided by law, such tax shall be identical in its application and exemptions there from to the Kansas Retailers’ Sales Tax Act and all laws and administrative rules and regulations of the Kansas Department of Revenue relating to the state retailers’ sales tax shall apply to such city retailers’ sales tax insofar as such laws and regulations may be made applicable. The services of the Department of Revenue shall be utilized to administer, enforce and collect such tax.
