(a) It is unlawful for any person to install, store, use or otherwise maintain any liquefied petroleum gas cylinder bottle or tank large than a fifty (50) gallon individual capacity on residential property. It is further unlawful for any person to install, store, use or otherwise maintain any combination of cylinders, bottles or tanks with capacity greater than one-hundred (100) gallons in the aggregate on any residential property. These regulations shall not apply in any areas within the City where natural gas is not available for heating and/or cooking purposes.
(b) Any installations of liquefied petroleum gas cylinders, bottles or tanks shall meet the requirements of the 2003 edition of the International Fire Code and NFPA 58.
(c) Liquefied petroleum gas cylinders, bottles or tanks having a water capacity of five hundred (500) gallons or less may be used on a temporary basis on construction sites, but not for longer than one-hundred eighty (180) days in any twelve (12) month period. Anyone intending such use must obtain a permit to do so from the City. Permits will be issued if such use does not pose a significant fire or explosion risk, and will be issued subject to such reasonable conditions as are described in the permit.
(d) Liquefied petroleum gas cylinders, bottles or tanks having a water capacity of five hundred (500) gallons or less may be used by permit of the City with the approval of the fire department in industrial areas where in the opinion of the fire chief or his/her designee indicate it would be safe to do so.
(e) The following terms, as used in this section, shall be defined as follows:
(1) “Residential property” shall mean any property located within any district in the city zoned R-1, R-2, R-3, MH-1, MH-2, any planned unit development district that contains residential buildings, or any property upon which a residential building is situated.
(2) “Residential building” shall mean a building all or part of which contains one or more dwelling units, including single-family dwellings, two-family dwellings, multiple-family dwellings, earth-sheltered housing, lodging houses, dormitories, sororities and fraternities, as well as modular homes.
(3) “Construction site” shall mean any location where construction work is being actively pursued for which a building permit has been issued by the city.
(4) “Industrial area” shall mean any property located within any district in the city zoned A-1, I-1, I-2 and B-4.
(f) Except as provided herein, no liquefied petroleum gas cylinders, bottles or tanks may be maintained in any district in the city except for personal, recreational, or non-resale use.
